Avis and Budget damage charges: how to dispute one
Updated
General information, not legal advice. The outcome depends on the facts of your case.
Avis and Budget belong to the same group, Avis Budget, which also owns Maggiore in Italy. If one of them has charged you for damage you dispute, the steps are the same: reply in writing, ask for the proof, get the final answer, then use the free dispute service that all three take part in. This guide is not linked to Avis, Budget or Maggiore in any way.
Where to send your dispute
We did not find a published damage-dispute address for Avis or Budget in Europe. Use the address or email on the damage letter or invoice itself, or the customer service contact on your rental agreement. Keep a copy of everything you send, and do not settle anything by phone. A call leaves no record.
What to write
Say clearly that you dispute the charge and why. Ask for the charge to be put on hold while the dispute is open. Then ask for:
- the check-out report from pick-up and the check-in report from return;
- the photos of the damage, with dates and times;
- when the car was inspected after the return, where, and by whom;
- if you returned the car out of hours, the key-drop record;
- at least 2 repair quotes, or the real repair invoice;
- how the amount was worked out, and if a price table was used, which line.
You do not have to prove you did nothing. The company has to show that the damage exists, that it was not there when you collected the car, that it happened during your rental and is more than normal wear, and what it really costs to repair.
The rules Avis Budget agreed to
Avis Budget was one of the five large rental groups that gave commitments to EU consumer authorities in 2015. The authorities said in 2019 that Avis would be fully in line by May 2019. The industry guidelines that came out of that process say that, before any damage charge, the company should give you evidence of the damage and how the cost was calculated, give you a reasonable time to challenge it, and put the charge on hold if you do.
If you paid by Visa, the card rules also say the company must send you, within 10 business days of the return and before charging, an explanation, at least 2 repair quotes and a statement that paying by card is optional, and then wait 20 business days. If you paid by Mastercard, card acquirers quote a rule that you must authorise a damage charge after being told about the damage. Note what was missing.
In Italy, the competition authority found a clause in Avis Budget Italia's terms unfair in a separate case. We have not seen the clause itself, so we only mention it.
Get the final answer
Keep the exchange in writing until the company gives you its final answer. That is the key that opens the free dispute service.
ECRCS: free, and binding on Avis, Budget and Maggiore
All three take part in the European Car Rental Conciliation Service (ECRCS). You can use it if:
- you live in the EU or the UK and rented in a different EU country;
- you booked directly with Avis, Budget or Maggiore, not through a broker;
- you have the company's final answer, and you file within 12 months of it;
- you have not raised the case with your bank or a court.
The decision binds the company, not you, and it is free. Read how ECRCS works first. For a rental in the UK, the BVRLA's free service covers its members' UK rentals.
If ECRCS is not open to you
- Booked through a broker: ECRCS does not take broker bookings. If you live in the EU, Norway or Iceland, the European Consumer Centre in your country can help for free.
- The money is gone: a card dispute may work if the company skipped the card rules. Do not call it fraud. See our card dispute guide, and contact your bank within about a month of the charge.
- Rental in Germany: under German law the company's damage claims become time-barred 6 months after it got the car back.
Honest limits
If you signed a return report showing the damage, or there was an accident, the case is harder and may only be about the amount. ECRCS does not award compensation and says it cannot judge repair costs. The result is never certain.
In short
- Write to the address on the claim, ask for the evidence and the hold.
- Note any missing notice or repair quotes.
- Get the final answer, then ECRCS within 12 months, before your bank.
If you want the letters written for your rental, our pack does that for a flat fee after a free check.
